Dorothy Schell (Petitioner) was the income beneficiary of a residuary trust established by her deceased husband’s will. The will stipulated that upon termination, if deemed impractical to administer by the trustee, the remaining fund would be paid to the person then eligible to receive income. The trustee, PNC Bank, determined it was impractical to continue administering the trust, which held real estate and other funds, and dissolved it on December 19, 2009. The total value was $302,463.52. Concurrently with the termination, Petitioner executed a renunciation of her rights to any income or principal from the trust. The trustee then distributed the assets to Petitioner’s children. In 2011, Petitioner applied for Medical Assistance – Long Term Care (MA-LTC) benefits. The Department of Public Welfare (DPW) determined that the renunciation constituted a transfer of assets for less than fair consideration within the 60-month look-back period, imposing a period of ineligibility. An undue hardship waiver reduced the penalized amount to $151,231.76. The Bureau of Hearings and Appeals (BHA) affirmed this determination.
