Case Brief Summary & Legal Analysis

4 min read

tl;dr: A mother sued a city after two on-duty white officers shot and killed her son, an off-duty Black officer. The court found the city could be liable for failing to train officers on avoiding misidentification but not for its hiring decision.

Legal Significance: The case clarifies the high but not insurmountable bar for establishing municipal liability under § 1983 for failure to train, particularly where a dangerous policy (always armed/on-duty) exists, contrasting it with the even stricter standard for inadequate hiring claims under Bryan County.

Case Facts & Court Holding

Key Facts & Case Background

Two on-duty Providence police officers, Solitro and Saraiva, shot and killed Cornel Young, Jr., an off-duty African-American officer, mistaking him for a threat. Young was responding to a disturbance pursuant to a departmental “always armed/always on-duty” policy. Young’s mother, as administratrix of his estate, sued the City of Providence and police supervisors under 42 U.S.C. § 1983. A jury found Officer Solitro, but not Saraiva, used excessive force in violation of the Fourth Amendment. The plaintiff alleged the City was liable under Monell v. Department of Social Services for this violation due to its deliberate indifference in failing to adequately train officers on the risks of misidentification inherent in its “always armed/always on-duty” policy, and for inadequately screening Solitro before hiring him. The plaintiff presented evidence, including testimony from the Police Commissioner, that the City knew its policy was dangerous and that training on avoiding “friendly fire” was necessary, but provided little to no such training. The district court granted summary judgment for the City on all claims.
