The Biologics Price Competition and Innovation Act of 2009 (BPCIA) creates an abbreviated pathway for FDA approval of biosimilars and a complex procedural framework for resolving patent disputes, known as the “patent dance.” Under 42 U.S.C. § 262(l)(2)(A), a biosimilar applicant “shall provide” its application and manufacturing information to the reference product sponsor (the patent holder). Amgen Inc. manufactures the biologic drug Neupogen. Sandoz Inc. filed an application for a biosimilar version, Zarxio.
