Elizabeth H. Ryan and Alexandra Monett owned adjacent properties. A 1958 written agreement, executed by Ryan’s predecessor, created a servitude of overhang for a roof (8 inches) and cornice (1 foot) from Monett’s building (2708 Coliseum Street) onto Ryan’s property (2700 Coliseum Street). Subsequently, Monett installed four window unit air conditioners on her building that extended beyond the property line, overhanging Ryan’s property. Ryan sought a preliminary injunction to compel Monett to remove the air conditioners. The trial court issued a preliminary injunction permitting Monett to maintain the air conditioners, reasoning that predial servitudes existed by prescription and that the air conditioners constituted a permissible future advantage or necessary accessory right under the Louisiana Civil Code. Ryan appealed only the part of the injunction concerning the air conditioners.
