Plaintiff Russell Fitzgerald was admitted to a hospital for profusely vomiting blood. The defendant, Dr. Preston Manning, performed an exploratory surgery and determined the bleeding originated from the esophagus. He used a Senstaken-Blakemore tube to control the bleeding. Four days post-operation, believing the plaintiff’s condition was satisfactory, Dr. Manning ordered that he be given clear liquids by mouth. The next day, after Dr. Manning had left for a planned vacation, his partner discovered an esophageal leak (fistula) and discontinued the oral liquids. The plaintiff subsequently developed a severe infection (empyema) in his pleural cavity. Despite further treatment, the infection ultimately destroyed his left lung, which had to be surgically removed. Fitzgerald sued Dr. Manning for malpractice, alleging that the premature order for mouth feeding, among other acts, constituted negligence that caused the infection and the loss of his lung. At trial, the plaintiff’s sole expert witness testified on the issues of negligence and causation. The district court granted a directed verdict for the defendant.
