In 1992, Johnnie Russ and her son, Elliott, opened a joint checking account into which all of Johnnie’s income was deposited. For the next nine years, while Johnnie lived with Elliott and his wife, the funds were used for shared family expenses in a “shared wallet” arrangement. In 1999, Johnnie executed a standard Wisconsin durable power of attorney (POA) form, naming Elliott as her agent. The form granted Elliott authority to manage her bank accounts but did not explicitly authorize him to make gifts, receive compensation, or engage in self-dealing. Johnnie also declined to require that Elliott provide an accounting. After the POA was executed, the parties continued their financial arrangement as before. Following Johnnie’s incapacitation, her guardian sued Elliott, alleging he breached his fiduciary duty by withdrawing $34,379.91 from the joint account for his personal and business use while acting as her agent. The circuit court, after initially granting summary judgment for Johnnie, reversed its decision and dismissed the complaint, finding that the parties intended for Elliott to have free use of the funds.
