The ordinance assigned one animal unit to each swine, regardless of its size or age, based on the “odor producing characteristics of animal wastes.” Due to his property’s location, Richardson was granted a special exception permit limiting him to 1,999 animal units, or 1,999 pigs. Richardson contended that an economically viable operation required approximately 4,200 pigs and that the ordinance was irrational because his small nursery swine (under 55 lbs) produce significantly less odor than full-grown hogs. He unsuccessfully sought a text amendment to the ordinance to create a fractional animal-unit value for nursery swine. The Township had considered and rejected a more complex system based on animal weight, citing administrative concerns, specifically the difficulty of enforcement (i.e., “who was going to go out and weigh the pigs”).
