The whaling ship Richmond wrecked in a remote, uninhabited part of the Arctic Ocean near Behring’s Straits. The vessel was unsalvageable, and with winter approaching, the crew and cargo faced certain loss. The crew escaped to shore, but their only hope of rescue lay with other whaling vessels in the area. Three such vessels, the Elizabeth Frith, Panama, and Junior, arrived. Their captains, seeing an opportunity to complete their own cargoes, proposed an “auction” for the Richmond’s oil and whalebone. The Richmond’s master, helpless and with no other options, acquiesced. The rescuing captains were the only bidders. They purchased the valuable cargo for nominal amounts—one dollar and seventy-five cents per barrel—and the ship’s hull for five dollars. No money was actually exchanged. The rescuers loaded the cargo onto their ships and departed. The owners of the Richmond filed a libel, arguing the sale was invalid and the rescuers should be treated as salvors entitled only to a salvage award, not as owners of the cargo.
