The plaintiff, Ploof, was sailing on Lake Champlain with his wife and two children when a sudden and violent storm arose, placing them and their sloop in great danger. To save his family and property from destruction, Ploof was compelled to moor the sloop to a dock owned by the defendant, Putnam. The dock was under the care of Putnam’s servant. The defendant’s servant then deliberately unmoored the sloop from the dock. As a direct result, the storm drove the sloop onto the shore, destroying it and its contents. Ploof and his family were thrown into the lake and injured. Ploof sued Putnam for damages resulting from the servant’s actions, alleging both intentional trespass to his property and negligence. The defendant demurred to the complaint, effectively arguing that Ploof was a trespasser and that the servant’s actions were therefore justified.
