The Plettners (plaintiffs) and the Sullivans’ predecessor-in-interest, the Hatchery (defendants), owned adjoining parcels of land. From 1962 to 1978, the Plettners and the Hatchery jointly used a road situated on the Hatchery’s property, which provided the sole access to the Plettners’ land. During this time, the Plettners believed the boundary line was west of the road. They demonstrated dominion over the land west of the road by planting a row of trees in 1963 and building three cabins between 1971 and 1973. The Hatchery conducted no activities on the land west of the road. In 1972, the Plettners improved the road by adding a rock top. In 1979, the Sullivans purchased the Hatchery’s property. A survey revealed the true boundary was located within the road, not west of it. The Sullivans then erected a fence in the road, blocking the Plettners’ access. The Plettners filed a quiet title action, claiming title to the land west of the road and the road itself through adverse possession, or alternatively, a prescriptive easement over the road.
