Perfect Fit Industries, Inc. (Plaintiff) sued Acme Quilting Co. (Defendant) for trade dress infringement under New York’s unfair competition law, alleging Acme deliberately copied the packaging (a “J-board”) for its mattress pads. The Second Circuit previously found for Perfect Fit, holding that secondary meaning was not required and that Acme’s copying created a likelihood of confusion. The court remanded for an injunction. On remand, the district court issued an order enjoining further use of the infringing trade dress and, significantly, compelling Acme to recall the offending J-boards from its customers. Acme failed to comply, claiming it never received a copy of the order and that the order was impermissibly vague because it referred to trial exhibits without attaching them. The district court subsequently held Acme in civil contempt and imposed a $5,000 per day fine for continued non-compliance. Acme appealed both the injunction’s recall provision and the contempt order.
