At approximately 2:30 a.m., the defendant, Kurt Von Staden, was driving with a passenger, Tracy White, after both had attended a party. Von Staden was intoxicated upon arrival at the party and continued to drink. His host urged him not to drive. Von Staden’s blood alcohol content (BAC) was estimated to be .22% at the time of the accident. While navigating a curve on a road with a 40 mph speed limit, Von Staden was traveling between 50 and 60 mph. A sign before the curve suggested a maximum speed of 35 mph. Due to darkness and fog, a highway patrol officer estimated the maximum safe speed for the curve was only 25 to 30 mph. Von Staden lost control of his vehicle, crossed into the oncoming lane, and crashed into a telephone pole, killing White. A jury convicted Von Staden of vehicular manslaughter with gross negligence under former Penal Code § 192, subd. (c)(3).
