Harold D. Persinger was charged with conspiracy to unlawfully deliver a controlled substance (Nembutal) with his wife, Ida Frances Persinger. The State’s evidence included observations of four controlled purchases of pills from Ida Persinger at their residence. During the final purchase on June 23, 1975, an undercover agent observed the defendant on the porch with his wife. Ida asked the defendant for his pocket knife to scratch the prescription label off a pill container before selling it to the agent; the defendant provided the knife and then entered the house. A pharmacist testified that prescriptions for Nembutal and Librium were filled for the Persinger account. Mary Scammahorn testified to regularly buying pills from Ida Persinger, often in the defendant’s presence. Scammahorn also recounted an incident where the defendant demanded payment for pills, stating, “You didn’t give us a receipt for the pills,” and then wrote a receipt signed by his wife. The defendant denied knowledge of his wife’s sales, denied giving her a knife during the June 23rd transaction, and offered an alternative explanation for the bank incident.
