The situation escalated into a medical emergency when a nasal pack securing string was cut, causing profuse bleeding and a risk of suffocation. While attempting to use a suction machine to clear the patient’s airway, Dr. Peete was assisted by the plaintiff, Nurse Beverly Blackwell. Blackwell testified that during the procedure, Peete struck her on the forearm and demanded she “turn on the [goddamn] suction.” Blackwell sustained no physical injury from the contact. Additional testimony indicated that prior to the incident, Peete had been “yelling and hollering,” had insulted other staff, and had thrown a patient’s chart. Blackwell sued Peete for assault and battery, seeking $1.00 in compensatory damages and $100,000 in punitive damages. The jury returned a verdict for Blackwell, awarding $1.00 in compensatory damages and $10,000 in punitive damages. Peete appealed, arguing the evidence did not support a punitive damages award.
