Appellant Bernice Patterson purchased several items from Walker-Thomas Furniture Co. on installment contracts. After defaulting, Walker-Thomas sued for the unpaid balance. Patterson raised the affirmative defense of unconscionability under the UCC, alleging the goods were so grossly overpriced that the contracts were unenforceable. To support this defense, Patterson sought to introduce evidence of the merchant’s pricing policies and the goods’ value. She served interrogatories on Walker-Thomas, issued a subpoena duces tecum for business records, and moved for the appointment of an expert witness to establish the items’ fair market value. The trial court sustained objections to the interrogatories, quashed the subpoena, and denied the motion for an expert.
