Plaintiff Helen Palsgraf was a passenger waiting on a Long Island Railroad platform. As another train began to depart, two men ran to board it. One man, carrying a package wrapped in newspaper, appeared unsteady. Two railroad employees, one on the train and one on the platform, attempted to assist him. In doing so, they dislodged the package, which fell onto the rails. The package, which contained fireworks, exploded. The concussion from the explosion knocked over a heavy scale located some distance away, which struck and injured the plaintiff. The plaintiff sued the railroad for negligence. At trial, the sole question of negligence submitted to the jury concerned the employees’ carelessness in handling the passenger boarding the moving train. The jury returned a verdict for the plaintiff. The defendant railroad appealed the judgment, arguing its employees’ actions were not the cause of the plaintiff’s injuries and that it was not chargeable with notice of the package’s contents.
