Plaintiff Janet Palmtag hired Gartner Construction Co. (defendant) to remodel her newly purchased home under an oral time-and-materials contract. Defendant possessed keys and controlled the site. Plaintiff visited periodically to monitor progress. During remodeling, defendant’s employee, Njus, removed a spiral staircase, leaving a 5-foot-square opening. Njus also removed underlying supports, believing the landing was contiguous with the floor; it was actually a separate, toenailed piece. He erected a minimal wire barricade that did not cover the entire opening or meet industry standards. Plaintiff, 8 months pregnant, arrived to review work as defendant’s employees were leaving. Unaware the staircase was gone, she noticed the wire, paused, saw the opening, and warned her son. As she paused, the unsupported landing collapsed, causing her to fall and sustain significant injuries, including a permanent disability. Expert testimony indicated the staircase supported the landing and its removal, along with other supports, weakened the structure. The barricade was deemed inadequate.
