Attorney Larry Stoller had a long-standing attorney-client relationship with Robert and Marcia Zylstra, representing them in various matters from 2002 to 2014. In January 2007, Stoller briefly consulted with Robert Zylstra regarding manure easement agreements that Zylstra intended to enter into with NuStar Farms, LLC, but advised him to seek specialized counsel. In December 2013, Stoller began representing the Zylstras in a small claims matter that was still pending. In early May 2014, while the small claims case was ongoing, Stoller began representing NuStar in a dispute against the Zylstras concerning a property deed. On behalf of NuStar, Stoller contacted the Zylstras multiple times demanding the deed. On May 13, 2014, Stoller sent an email to the Zylstras threatening legal action on behalf of NuStar if the deed was not delivered and, in the same email, stated he would no longer represent them in any future matters. The small claims court did not issue its ruling until May 30. In July, Stoller filed a petition for NuStar against the Zylstras, which included a count related to the 2007 manure easements. The Zylstras moved to disqualify Stoller based on a conflict of interest.
