Case Brief Summary & Legal Analysis

4 min read

tl;dr: The Supreme Court upheld the Presidential Recordings and Materials Preservation Act, which directed federal archivists to take custody of former President Nixon’s papers, rejecting his constitutional challenges based on separation of powers, presidential privilege, privacy, and bill of attainder.

Legal Significance: This case affirmed Congress’s power to regulate a former President’s official papers for public interest, balancing executive privilege and privacy against governmental needs, and clarified the scope of the Bill of Attainder Clause concerning non-punitive, specific legislation.

Case Facts & Court Holding

Key Facts & Case Background

Following President Richard M. Nixon’s resignation, Congress enacted the Presidential Recordings and Materials Preservation Act (PRMPA). Title I of the Act directed the Administrator of General Services (GSA) to take custody of Nixon’s presidential historical materials, including tape recordings and documents. The Act mandated the GSA to promulgate regulations for processing these materials, returning purely personal items to Nixon, and determining public access terms. This legislation effectively abrogated a prior agreement between Nixon and the GSA (the Nixon-Sampson agreement) that would have allowed Nixon greater control, including the destruction of certain tapes. Nixon challenged the Act’s facial constitutionality, arguing it violated: (1) the separation of powers; (2) presidential privilege; (3) his personal privacy rights; (4) his First Amendment associational rights; and (5) the Bill of Attainder Clause. The District Court upheld the Act, limiting its review to the facial validity of the custodial and screening provisions, as public access regulations were not yet effective.

Court Holding & Legal Precedent

Issue: Does the Presidential Recordings and Materials Preservation Act, by directing the Administrator of General Services to take custody of and screen a former President’s historical materials, facially violate the principles of separation of powers, presidential privilege, the former President’s rights to privacy and association, or the Bill of Attainder Clause?
