Pari Ahmadi suffered permanent paralysis due to a misdiagnosis of her vitamin B-12 deficiency. Her physicians at the Neurology Center (NC) ordered a B-12 test from National Health Laboratories (NHL). NHL admittedly erred in its testing methodology, reporting a normal B-12 level on July 11, 1986. NC physicians, particularly Dr. Pulaski, relied on this incorrect result to rule out B-12 deficiency and diagnose Ahmadi with Multiple Sclerosis (MS), despite symptoms consistent with B-12 deficiency. A second B-12 test ordered at George Washington University Hospital was never performed, and NC continued to rely on NHL’s erroneous result. Over several months, Ahmadi’s condition worsened. In February 1987, a different doctor correctly diagnosed severe B-12 deficiency, but by then Ahmadi was permanently paralyzed. A jury found both NC and NHL negligent. The trial court ordered 50% contribution from each, denying cross-claims for indemnification. NC argued NHL should indemnify it; NHL argued NC’s negligence was a superseding cause or that NHL was entitled to indemnity/apportionment.
