Dora Mugaas (Plaintiff) and her predecessors occupied and used a strip of land adjacent to their property. From 1910 until approximately 1928, a fence clearly marked the boundary of this strip. After 1928, the fence disintegrated and was not replaced. In 1941, Delmar Smith (Defendant) purchased the adjoining property. The legal description in Smith’s deed, which reflected the public record, included the disputed strip of land. At the time of his purchase, there were no visible markers or signs of Mugaas’s claim to the strip, and Smith was a bona fide purchaser for value without notice. After Smith began to build on the strip, Mugaas filed an action to quiet title, claiming she had acquired ownership through adverse possession long before Smith’s purchase. The trial court found that Mugaas had satisfied the statutory requirements for adverse possession and that her title had vested no later than 1928. Smith appealed, arguing his status as a bona fide purchaser relying on the record title should defeat Mugaas’s unrecorded and no longer apparent claim.
