Elizabeth Morgan (mother) and Eric Foretich (father) were engaged in a protracted custody dispute over their daughter, H. Morgan was awarded custody, and Foretich received visitation rights. Morgan repeatedly alleged that Foretich was sexually abusing H during these visits. After extensive hearings, the trial court found that Morgan had failed to prove the abuse allegations by a preponderance of the evidence. The court had previously held Morgan in contempt for refusing visitation, a decision affirmed on appeal. Subsequently, the trial court ordered a gradual resumption of visitation, culminating in an order for a two-week unsupervised summer visit.
