The City of Central Falls, facing severe financial insolvency, initially petitioned a state court for a judicial receiver. In response, the Rhode Island General Assembly passed the Financial Stability Act, creating a state-controlled, tiered process for intervening in fiscally distressed municipalities. The Act authorized the state’s Director of Revenue to appoint a receiver with powers superior to those of local elected officials and retroactively prohibited judicial receiverships. After Central Falls consented to the new process, the Director appointed a receiver who assumed the duties of the Mayor and City Council, reducing them to an advisory capacity and cutting their compensation.
