Respondent Paul Gibbs was hired as a mine superintendent and awarded a haulage contract by a company attempting to open a new mine with members of a rival union. Petitioner United Mine Workers of America (UMW) members, who believed they were promised the jobs, responded with a violent confrontation that prevented the mine from opening. Gibbs lost both his job and his haulage contract. He filed suit against the UMW in federal district court. The complaint alleged two claims: a federal claim under § 303 of the Labor Management Relations Act for damages from an illegal secondary boycott, and a state law claim for tortious interference with his contracts. Both claims arose from the same labor dispute and the ensuing violence and picketing. There was no diversity of citizenship, so federal jurisdiction over the state law claim depended entirely on its relationship to the federal claim under the doctrine of pendent jurisdiction. The trial court dismissed the federal claims but entered judgment for Gibbs on the state law claim.
