Millbrook Hunt, Inc. (“the Hunt”) entered into a 75-year “Lease and Easement Agreement” with a landowner, allowing it to use a large parcel for fox hunting. The agreement specified the long term and granted the Hunt the right to maintain trails. It also reserved the landowner’s right to develop the land and relocate the trails, but not to completely exclude the Hunt. The defendant, Edgar O. Smith, later purchased the 285-acre property with actual and constructive notice of this agreement. Objecting to hunting, Smith attempted to eject members of the Hunt from the property, claiming the agreement was merely a revocable license that he had terminated. The Hunt sued for a declaratory judgment that it held an easement and sought an injunction to prevent Smith’s interference. The trial court found in favor of the Hunt, and Smith appealed.
