To celebrate Michael Jordan’s induction into the Basketball Hall of Fame, Sports Illustrated published a commemorative issue. Jewel Food Stores, a supermarket chain, received free advertising space in the issue in exchange for an agreement to stock and sell it. Jewel submitted a full-page ad that congratulated Jordan. The ad prominently featured the Jewel-Osco logo and its marketing slogan, “Good things are just around the corner.” The ad’s text read, in part: “Jewel-Osco salutes #23 on his many accomplishments as we honor a fellow Chicagoan who was ‘just around the corner’ for so many years.” Jordan, who did not authorize the ad, sued Jewel for $5 million, alleging violations of the federal Lanham Act and the Illinois Right of Publicity Act, among other claims. Jewel moved for summary judgment, arguing the ad was noncommercial speech fully protected by the First Amendment. The district court agreed with Jewel. Jordan appealed.
