In 1816, the U.S. Congress chartered the Second Bank of the United States. The Bank subsequently opened a branch in Baltimore, Maryland. In 1818, the Maryland General Assembly passed a law imposing a tax on all banks operating in the state that were not chartered by the Maryland legislature. The statute required targeted banks to either pay an annual tax of $15,000 or purchase specially stamped paper for their bank notes. James W. M’culloch, the cashier of the Baltimore branch of the Bank of the United States, issued bank notes without complying with the Maryland law. The State of Maryland brought an action against M’culloch to recover the statutory penalties. The Maryland Court of Appeals upheld the judgment against M’culloch, affirming the constitutionality of the state tax. M’culloch appealed to the Supreme Court of the United States, presenting a direct conflict between a federal law (the Bank’s charter) and a state law (the tax).
