Floyd Perkins was convicted of first-degree murder in Michigan in 1993. His conviction became final in 1997. The Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) imposes a one-year statute of limitations for federal habeas corpus petitions, which for Perkins expired in 1998. Over the next several years, Perkins obtained three affidavits suggesting another man, who was the key prosecution witness, was the actual murderer. The latest affidavit was dated July 16, 2002. Despite possessing this evidence, Perkins did not file his federal habeas petition until June 13, 2008, more than a decade after his conviction was final and nearly six years after obtaining the last affidavit.
