The rules further provided that “in no case can an employee demand payment” except when the company’s trustees, in their sole discretion, adjudged it payable. The trustees were authorized to decide all questions “without appeal.” After being discharged, the plaintiff, McNevin, had $52.54 credited to his account in a passbook. He requested payment, but the trustees, after a hearing, decided not to pay him. McNevin sued, arguing he had a contractual right to the credited amount. The trial court found for McNevin, and the defendant appealed.
