Marilyn McClellan, a member of the Health Maintenance Organization of Pennsylvania (HMO), selected Dr. Joseph Hempsey as her primary care physician (PCP) from a list provided and marketed by the HMO. The HMO represented that its participating physicians were qualified and had passed “vigorous screening criteria.” Under the HMO plan, members were required to see their assigned PCP for initial care and could only see a specialist upon referral from the PCP. Dr. Hempsey removed a mole from McClellan’s back which had recently changed in appearance, but he discarded the tissue without ordering a biopsy. McClellan was subsequently diagnosed with malignant melanoma and died. Her estate (Appellants) sued the HMO, alleging it was vicariously liable for Dr. Hempsey’s negligence under a theory of ostensible agency. The complaint also asserted direct liability against the HMO for corporate negligence in its selection and retention of Dr. Hempsey, as well as claims for misrepresentation and breach of contract. The trial court sustained the HMO’s preliminary objections (demurrer) and dismissed the complaint.
