Steve J. Pilafas (decedent) created an inter vivos trust, naming himself trustee and funding it with real and personal property. The trust agreement, in Article X, stipulated that the Settlor could amend or revoke the trust “by instrument in writing delivered to the Trustee.” Decedent twice amended the trust using this method. Simultaneously with the second amendment, he executed a pour-over will. After these executions, decedent expressed intent to revise his estate plan to include children previously omitted. Upon his death, neither the original will nor the original trust documents could be found despite a diligent search of his meticulously kept records. Decedent was known to discard papers that offended him. Appellees, his disinherited children, petitioned for a determination that both the will and trust were revoked and that decedent died intestate. The trial court found both instruments revoked. The remainder beneficiaries under the trust appealed the finding regarding the trust’s revocation.
