Petitioner Joseph Massaro was convicted of federal racketeering and murder. During his trial, the prosecution disclosed the late discovery of a bullet allegedly recovered from the victim’s car. The trial court offered defense counsel a continuance to examine the evidence, which counsel declined. Massaro was convicted. On direct appeal, Massaro was represented by new counsel who challenged the admission of the bullet but did not raise a claim of ineffective assistance of trial counsel (IAC). Subsequently, Massaro filed a motion to vacate his conviction under 28 U.S.C. § 2255, arguing that his trial counsel had been constitutionally ineffective for failing to accept the continuance. The District Court denied the motion, and the Second Circuit Court of Appeals affirmed, holding the IAC claim was procedurally defaulted. The Second Circuit applied its rule that an IAC claim apparent from the trial record must be raised on direct appeal when the defendant has new appellate counsel. The Supreme Court granted certiorari to resolve a conflict among the Courts of Appeals on this procedural issue.
