Defendant Andrew J. Fowler, who had completed two years of law school, purchased a 15-acre tract of land in 1955 for a nominal price of $100. The property’s last record owner was Sallie Jones, who had acquired it in 1916. Fowler purchased the property from two vendors who were not of record and whose connection to Sallie Jones was not established by succession proceedings. Fowler personally drafted the deed, which used quitclaim language conveying only “all their right, title and interest” in the property, rather than warranting full ownership. The consideration was substantially below the property’s actual value. Fowler was aware of the break in the chain of title and relied on a questionable letter to establish his vendors’ heirship. When a co-owner, Malone, filed suit for partition, Fowler asserted ownership through ten-year acquisitive prescription under Louisiana Civil Code Article 3478, claiming he was a good faith possessor at the time of purchase.
