On August 11, 1977, Salvador Maldonado, a Mexican citizen, attempted to board a Southern Pacific freight train in Picacho, Arizona. He alleged that four employees of Southern Pacific Transportation Company (Southern) caused a “jerking or bumping” of the train cars as he tried to board, causing him to fall under the wheels. Maldonado suffered a severed left arm, a broken left leg, and other serious, bleeding wounds. His complaint included five claims: intentional infliction of injury, wanton and reckless infliction of injury, interference with a savior, failure to render aid, and failure to call for medical assistance or report the injury. Specifically, regarding the failure to render aid (Count IV), Maldonado alleged that after being severely injured and lying helpless, Southern Pacific employees on the caboose saw him and heard his calls for help but did nothing and continued past him. He claimed this caused additional emotional distress. The trial court dismissed Counts III, IV, and V. Maldonado appealed the dismissal.
