Printz Services Corp., a general contractor, hired C.J. Masonry as a subcontractor for a casino construction project. Their written contract, prepared by Printz, contained a payment clause stating: “Contractor shall make final payment to Subcontractor after work is complete… provided like payment shall have been made by Owner to Contractor.” Before the project’s completion, the owner became insolvent and failed to pay Printz.
