The defendant, Patrick Maher, was charged with assault with intent to murder Patrick Hunt. The prosecution’s evidence showed that Maher, appearing highly agitated and sweating, entered a saloon and shot Hunt in the head with a pistol, causing a severe but non-fatal wound. At trial, Maher sought to introduce evidence to show provocation. He offered to prove that less than thirty minutes before the assault, he had witnessed his wife and Hunt going into the woods together under circumstances suggesting an adulterous purpose. Maher followed them. Shortly after they emerged, as Maher was pursuing Hunt, a friend informed Maher that Hunt and his wife had also committed adultery the previous day. Maher then immediately went to the saloon where the assault occurred. The trial court excluded all evidence related to the alleged adultery. Maher was convicted, and he appealed on the grounds that the evidence was improperly excluded.
