Lincoln General Insurance Company insured a bus owned by Senators Rental, Inc. The bus was manufactured by Prevost Car (US) Inc. and contained an engine produced by Detroit Diesel Corporation. While in operation, the bus caught fire due to an alleged engine defect. The fire resulted in the total loss of the bus but caused no personal injuries or damage to any other property. Lincoln General paid its insured, Senators Rental, $405,250 for the loss of the bus under the insurance policy. As subrogee, Lincoln General then filed a lawsuit against Prevost and Detroit Diesel, asserting claims for breach of warranty, negligence, and strict products liability to recover the amount it paid. The defendants argued that the tort claims (negligence and strict liability) were barred by the economic loss doctrine because the only damage was to the product itself. The U.S. District Court certified a question to the Tennessee Supreme Court to clarify the state’s position on the doctrine.
