The Virginia Constitution and a state statute mandated that all proceedings before the state’s Judicial Inquiry and Review Commission remain confidential. The statute made it a misdemeanor for “any person” to divulge information about these proceedings. Landmark Communications, Inc., published an article in its newspaper, the Virginian Pilot, that accurately reported on a pending inquiry before the Commission and identified the judge being investigated.
