Later that night, a police dispatcher sent Brooks to investigate a complaint involving Lamkin at a location outside the town’s territorial limits. After an initial exchange, Brooks began to leave but then returned to the scene, still outside the town’s jurisdiction. He was in his police car and uniform, and later claimed he returned to record Lamkin’s license plate for an official “incident report.” An altercation ensued, during which Brooks struck Lamkin without provocation, causing severe facial fractures. The entire series of events, from the initial contact to the final assault, stemmed from Brooks’s performance of his police duties. Lamkin sued Brooks and the Town of Lecompte for damages. The lower courts found Brooks liable but absolved the Town, reasoning the act occurred outside its jurisdiction and was therefore outside the scope of employment.
