tl;dr: A bi-state agency created by interstate compact was sued for a constitutional violation. The Court held the agency was not an “arm of the state” entitled to Eleventh Amendment immunity, but its board members had absolute immunity for their legislative acts.

Legal Significance: Establishes that bi-state agencies created by compact are not automatically entitled to Eleventh Amendment immunity. It also extends absolute legislative immunity under § 1983 to non-elected regional officials performing legislative functions.

Case Facts & Court Holding

Key Facts & Case Background

California and Nevada formed the Tahoe Regional Planning Agency (TRPA) via an interstate compact, approved by Congress, to regulate land use in the Lake Tahoe Basin. The compact designated TRPA as a “separate legal entity” and a “political subdivision.” Its governing board consisted mainly of appointees from local counties and cities, with only a minority appointed by the states. The compact stipulated that TRPA’s funding would come from the counties, not the states, and that its obligations were not binding on the states. Property owners sued TRPA and its individual board members under 42 U.S.C. § 1983, alleging that a land-use ordinance amounted to an unconstitutional taking of their property. The lower court held that TRPA was immune from suit under the Eleventh Amendment. The Supreme Court granted certiorari to determine TRPA’s Eleventh Amendment immunity and the personal immunity of its board members.
