Case Brief Summary & Legal Analysis

4 min read

tl;dr: The FTC found Kraft’s cheese ads deceptively implied false calcium claims. The court upheld the FTC’s order, affirming that an agency can find an ad misleading based on its own analysis without consumer surveys, so long as the implied claim is reasonably clear.

Legal Significance: This case affirms the FTC’s authority to find advertisements implicitly deceptive without extrinsic evidence, provided the implied claim is reasonably clear from the ad’s face. It reinforces a deferential standard of review for the FTC’s factual findings, even when commercial speech is implicated.

Case Facts & Court Holding

Key Facts & Case Background

Kraft, Inc. launched an advertising campaign for its Kraft Singles cheese slices, known as the “Five Ounces of Milk” campaign. The ads stated that each slice was made from five ounces of milk and was high in calcium. The Federal Trade Commission (FTC) filed a complaint, alleging the ads made two false implied claims: (1) that a slice of Singles contains the same amount of calcium as five ounces of milk (the “milk equivalency” claim), and (2) that Singles contain more calcium than most imitation cheese slices (the “imitation superiority” claim). In reality, about 30% of the milk’s calcium is lost during processing, and most imitation slices are fortified to contain a similar amount of calcium as Singles. The FTC, relying primarily on its own interpretation of the ads’ “overall net impression” rather than extrinsic consumer survey evidence, found the ads deceptive. It issued a broad cease and desist order covering all of Kraft’s cheese products. Kraft petitioned for review, arguing the FTC was required to use extrinsic evidence and that its findings were not supported by substantial evidence.

Court Holding & Legal Precedent

Issue: May the Federal Trade Commission, without relying on extrinsic evidence such as consumer surveys, determine that an advertisement makes a deceptive implied claim that is reasonably clear from the face of the advertisement?
