Following the attack on Pearl Harbor, President Franklin D. Roosevelt issued Executive Order 9066, authorizing the Secretary of War to designate military areas from which any or all persons could be excluded. Pursuant to this order, the Commanding General of the Western Command issued Civilian Exclusion Order No. 34, which required all persons of Japanese ancestry, including U.S. citizens, to leave a designated area in San Leandro, California. Congress passed a law making it a federal offense to knowingly violate such an order. Fred Korematsu, an American citizen of Japanese descent whose loyalty to the United States was not questioned, remained in the restricted area in violation of the order. He was arrested and convicted in federal court. Korematsu challenged his conviction, arguing that the order was an unconstitutional discrimination based on race.
