Case Brief Summary & Legal Analysis
tl;dr: The Supreme Court declined to overrule the Auer deference doctrine but significantly limited its application, establishing a rigorous multi-step framework that courts must apply before deferring to an agency’s interpretation of its own ambiguous regulation.
Legal Significance: This case reframes Auer deference from a reflexive command into a multi-part test, preserving the doctrine while substantially limiting its scope and reinforcing the judiciary’s role in interpreting regulations. It marks a significant recalibration of judicial review in administrative law.

Case Facts & Court Holding
Key Facts & Case Background
Petitioner James Kisor, a Vietnam veteran, sought retroactive disability benefits from the Department of Veterans Affairs (VA). His entitlement to such benefits hinged on a VA regulation, 38 C.F.R. § 3.156(c)(1), which permits an earlier effective date if “relevant official service department records” were not previously considered. Kisor submitted new records confirming his participation in a specific combat operation. The Board of Veterans’ Appeals, in a non-precedential adjudication by a single administrative judge, interpreted “relevant” to mean only records that address the specific basis for the initial denial of benefits. Because Kisor’s initial denial was due to a lack of a PTSD diagnosis, not a dispute over his combat service, the Board found the new records were not “relevant.” The Court of Appeals for the Federal Circuit found the regulation ambiguous as to the meaning of “relevant.” It then applied Auer deference to the Board’s interpretation, holding that the reading was not “plainly erroneous or inconsistent with the VA’s regulatory framework,” and affirmed the denial of retroactive benefits. The Supreme Court granted certiorari to decide whether to overrule Auer v. Robbins and its predecessor, Bowles v. Seminole Rock & Sand Co.
