Plaintiff Kerry Ellison, an IRS agent, received unwanted attention from a coworker, Sterling Gray, with whom she had little contact beyond one lunch. Gray gave Ellison a note stating, “I cried over you last night.” Frightened, Ellison had a coworker tell Gray to leave her alone. While Ellison was away for training, Gray mailed her a three-page, single-spaced letter describing his feelings, stating he had been “watching” and “experiencing” her, and making references to sex. Ellison reported the conduct to her supervisor, who counseled Gray and arranged his temporary transfer to another office. However, the employer later agreed to allow Gray to return to Ellison’s office after a six-month separation to settle a union grievance. Upon learning of Gray’s impending return, Ellison became “frantic,” requested a temporary transfer for herself, and filed a formal sexual harassment complaint. The Treasury Department and the EEOC found the employer’s remedial action adequate. Ellison sued in federal district court, which granted summary judgment for the employer, finding the conduct “isolated and genuinely trivial.”
