Relators, Stokes and others, had contracts with the Postmaster General for mail transportation. After disputes over credits and allowances, Congress passed an act on July 2, 1836, directing the Solicitor of the Treasury to settle their claims for extra services and to make allowances based on equity. The act further directed the Postmaster General, Amos Kendall, to credit the relators with whatever sum the Solicitor decided was due. The Solicitor awarded the relators $161,563.89. Kendall, however, credited only $122,102.46, refusing to credit the remaining balance of $39,462.43. The relators petitioned the Circuit Court of the District of Columbia for a writ of mandamus to compel Kendall to credit the full awarded amount. The Circuit Court issued the peremptory mandamus. Kendall appealed, arguing that the court lacked jurisdiction and that compelling him would infringe upon the executive department’s powers.
