Jacob Kanevsky died intestate. He had no surviving spouse, descendants, or parents. His only sibling, a brother named Nathan, had predeceased him. Nathan had two children: Paul Kay, the appellant, and Zena Kanevsky Swartz. Zena also predeceased Jacob, the intestate decedent. During her lifetime, Zena and her then-husband legally adopted Perry Swartz, the appellee. After Zena’s death, her surviving husband (Perry’s adoptive father) remarried.
