Gilles Schoukroun, during his terminal illness and marriage to Kathleen Sexton (his second wife), established a revocable inter vivos trust (the “Trust”) for his daughter, Lauren, from his first marriage. He named himself settlor and trustee, retaining the right to amend, terminate, receive income, and invade principal. Gilles funded the Trust with assets from three financial accounts and designated the Trust as the beneficiary of two IRA transfer-on-death (TOD) accounts. Upon Gilles’s death, Kathleen renounced his will, which left her tangible personal property and $200,000 in life insurance proceeds, and filed an election to take her statutory share under Md. Code, Est. & Trusts § 3-203. Kathleen argued that Gilles’s retained control over the Trust and IRAs rendered these transfers a per se fraud on her marital rights, or alternatively, that the circumstances indicated such fraud. The trial court found no fraud. The Court of Special Appeals reversed, holding that retained control constituted per se fraud. The trustee appealed.
