The landlord demanded a starting rent of $900 per month, while the tenant, after hiring an appraiser, contended that a fair market rental value was $545.41 per month. When negotiations failed, the tenant sued for specific performance to compel the landlord to renew the lease at a “reasonable rent” to be determined by the court. The landlord initiated a holdover proceeding to evict the tenant. The trial court dismissed the tenant’s complaint, finding the renewal clause unenforceable for uncertainty. The Appellate Division reversed, holding the clause could be enforceable.
