Emmett Jordan, an African-American firefighter for the City of Cleveland, endured years of racial hostility, including racial slurs, racist graffiti, and segregation within the fire division. After Jordan and other Black firefighters filed internal complaints and an EEOC charge against a particularly hostile white lieutenant, the harassment and retaliation escalated. Jordan was subjected to demeaning chores, excessive drilling, and involuntary transfers. Most significantly, he was systematically and repeatedly denied “acting time”—opportunities to serve as a temporary officer with a corresponding pay increase. The City accomplished this by placing other officers on his shift or by fabricating performance-related reasons, which were later admitted to be pretextual. The retaliation culminated in an incident where a captain damaged Jordan’s protective gear, publicly humiliated him, and threatened him for complaining. The cumulative stress from this conduct eventually forced Jordan to take disability retirement. A jury found in Jordan’s favor on his claims for retaliation and racial and retaliatory harassment.
