In 1973, Clabon Jones filed a claim for benefits for a “nervous” condition, which the VA regional office (RO) denied. Jones filed a Notice of Disagreement (NOD), placing the claim in appellate status. The VA, however, failed to issue the statutorily required Statement of the Case (SOC), leaving the 1973 claim procedurally pending. Over the next decade, Jones filed several requests to reopen his claim for a nervous condition, including PTSD. Following denials by the RO, Jones appealed to the Board of Veterans’ Appeals (Board). In a 1986 decision, the Board reviewed the entire evidentiary record on the merits and denied service connection for a nervous condition, including PTSD. In 1989, Jones again reopened his claim, which ultimately resulted in an award of benefits for PTSD. The VA assigned an effective date of May 1989. Jones appealed, arguing he was entitled to a 1973 effective date because his original claim was never finally adjudicated due to the VA’s failure to issue an SOC. The Board and the Veterans Court found that the 1986 Board decision constituted a final adjudication that resolved the pending 1973 claim.
